General Terms and Conditions

1.1 These General Terms and Conditions ("Terms") of MVMT Cycling ("Seller", "we", "us") apply to all contracts concluded between you ("Customer") and the Seller through our official digital storefront (the "Shop"), including the purchase of bicycle parts, integrated aero cockpits, wheelsets, and components.

1.2 Any conflicting or supplementary terms proposed by the Customer are expressly objected to and shall not become part of the contractual agreement unless agreed to in written form.

1.3 We may amend these Terms at any time for future purchase orders. Amendments will be published on this page with an updated effective date.

1.4 If you are a private consumer resident in the European Union or European Economic Area, all mandatory consumer protection statutory regulations of your country of residence apply unconditionally regardless of any clause herein.

In accordance with EU electronic commerce disclosure regulations, the Seller's registered corporate operating identity is as follows:

3.1 Product presentations in the online storefront represent a non-binding invitation to treat and do not constitute an unilateral offer by the Seller.

3.2 By completing the checkout process and clicking the order placement button, the Customer submits a legally binding purchase offer for the components in the cart.

3.3 The Seller accepts the offer by issuing a formal order confirmation email or by dispatching the goods from our European fulfillment warehouse, whichever occurs earlier. We reserve the right to reject orders in cases of stock discrepancies or manifest pricing errors, in which case all captured payments will be refunded in full immediately.

3.4 The contractual agreement is stored digitally and forwarded via email. Checkout is conducted in English.

Consumers contracting from within the European Union or European Economic Area enjoy a statutory right to withdraw from this contract within 14 calendar days without stating any reason.

Withdrawal Window: The withdrawal period expires 14 days from the date on which you, or a designated third party other than the courier, acquires physical possession of the final component ordered.

Exercising Your Right: To exercise this right, inform us via an unequivocal statement (e.g. email to info@mvmtcycling.com). You may use the standard model withdrawal template below.

Effects of Withdrawal: We reimburse all payments received from you, including standard outbound delivery costs, no later than 14 days from the day we receive your withdrawal notice. Reimbursement may be withheld until goods are received at our warehouse or verified dispatch proof is provided.

Exclusions from Statutory Withdrawal:

• Components manufactured to custom rider specifications (e.g. custom painted frames, cut steerers).
• Sealed hygiene items unsealed post-delivery (e.g. cycling bibs, saddles, handlebar grips).
• Parts showing signs of technical assembly, clamp indentation, or outdoor road testing wear.

5.1 For size exchanges or component consultations submitted beyond the statutory 14-day window, MVMT Cycling offers an extended voluntary return period of up to 30 days from the delivery date.

5.2 All components must be returned completely unmounted, unridden, in original retail protective cartons with full hardware kits and inspection certificates attached.

5.3 Return courier expenses are the Customer's responsibility unless the exchange arises from verified warehouse fulfillment errors or manufacturing non-conformity.

6.1 All product prices displayed across our storefront are final and stated in Euros (€ / EUR). Prices for European consumers include applicable statutory Value Added Tax (VAT).

6.2 Dispatch shipping rates are itemized transparently during checkout prior to final order confirmation.

6.3 Because all orders dispatch from within the European Union, European customers face zero additional import tariffs, customs duties, or hidden clearance fees.

6.4 Accepted payment options include Visa, Mastercard, American Express, PayPal, Apple Pay, and Google Pay through PCI-DSS Level 1 bank-grade gateways.

7.1 Items are dispatched to the shipping address supplied by the Customer via premier continental road courier partners (DPD, DHL Parcel, GLS).

7.2 Estimated transit timeframes are displayed during checkout. In-stock orders verified before 14:00 CET dispatch on the same working day.

7.3 For private consumers, the risk of accidental loss or courier transit damage transfers only upon physical delivery to the Customer or an authorized recipient.

8.1 Goods sold to consumers in the European Union are fully covered by the statutory two-year legal guarantee of conformity from delivery.

8.2 Any defect that becomes apparent within one year of delivery is presumed by law to have existed at the time of delivery, unless proven otherwise by technical inspection.

8.3 Warranty claims should be submitted to info@mvmtcycling.com along with order invoices, high-resolution imagery, and a technical description of the issue.

9.1 The Seller is liable without limitation for damages arising from injury to life, body, or health, for intentional misconduct or gross negligence, and under mandatory European Product Liability Directives.

9.2 For ordinary negligence, liability is limited strictly to foreseeable, typical damages arising from breach of essential contractual obligations.

9.3 Nothing in these Terms derogates from mandatory consumer protection regulations applicable under the laws of the consumer's domicile.

Our platform is provided on an "as available" basis. While we maintain high availability standards, we do not warrant uninterrupted access during essential server maintenance periods.

Bicycle racing and riding involve inherent kinetic risks. The Customer assumes responsibility for correct torque calibration and technical assembly, or for contracting a certified bicycle mechanic.

Customer personal data is processed strictly in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation). We do not sell or store unencrypted financial information.

We are not obliged and not generally willing to participate in dispute resolution proceedings before a consumer arbitration board, unless legally required for a specific EU member state. EU/EEA and UK consumers may contact their national consumer protection authority for assistance with any unresolved dispute. Our direct resolution contact is info@mvmtcycling.com.

Claims arising out of contractual relationships must be brought within statutory European limitation periods applicable in the consumer's country of habitual residence.

15.1 For consumers within the EU/EEA, this contract is governed by the laws of the Member State in which you reside. Consumers may bring proceedings before courts of competent jurisdiction in their country of residence.

15.2 The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

15.3 Should any individual provision of these Terms be deemed invalid, the validity of all remaining contractual provisions remains unaffected.
